女子销售含西地那非“草药咖啡”宣称可增强性功能，被判销售有毒、有害食品罪获刑A woman selling "herbal coffee" containing sildenafil, claiming to enhance sexual function, has been convicted of selling toxic and harmful food and sentenced to prison

5月26日，红星新闻记者从中国裁判文书网获悉，湖南省通道侗族自治县人民法院近日公布该案的一审刑事判决书，上述咖啡被检出含国家禁止在食品中添加的化学药物成分“西地那非”。杨某倩犯销售有毒、有害食品罪，被判处有期徒刑六个月，缓刑一年。

经法院审理查明，2024年开始，被告人杨某倩通过微信平台售卖性保健品。随后，她从微信好友处获悉一款名为“某天然草药咖啡”的产品，该产品宣称具有增强性功能的效果。2024年12月7日及2025年5月15日，杨某倩先后两次从上述微信好友处以每10盒1450元的价格购入20盒涉案咖啡（每盒内含22包），累计支付货款2900元。

经查，涉案咖啡未取得合格证明。杨某倩在非正规渠道进货且未履行产品质量查验义务的情况下以每盒200元至500元或每包20元至50元不等的价格对外销售。在销售涉案咖啡的过程中，杨某倩还以促销的方式向购买其他性保健品的客户免费赠送涉案咖啡。截至2025年7月17日被通道县市场监督管理局查获时，杨某倩已售出涉案咖啡12盒，另以促销方式赠送给客户6盒，自用1盒，现场查获23包。经核实，杨某倩售出的这12盒咖啡金额为3860元。

案发后，通道县市场监督管理局将查获的涉案咖啡4包送至江西求实司法鉴定中心进行成分鉴定，经检测，其中检出国家禁止在食品中添加的化学药物成分西地那非。

另查明，2025年7月24日，杨某倩主动前往公安机关投案，并如实供述其犯罪事实，主动退缴部分违法所得等。

证人莫某证实，其添加“小倩”微信后，得知小倩在卖提升性功能的“壮阳咖啡”，便于2025年5月19日凌晨，在微信花了20元买了一包“壮阳咖啡”，喝后身体发热，精神比较亢奋。

法院经审理认为，被告人杨某倩违反国家食品安全管理法规，销售明知掺有有毒、有害的非食品原料的食品，其行为已构成销售有毒、有害食品罪。依照相关法律之规定，判决如下：被告人杨某倩犯销售有毒、有害食品罪，判处有期徒刑六个月，缓刑一年，并处罚金一万二千元（罚金已缴纳）。

On May 26th, Red Star News learned from the China Judgments Online that the People's Court of Tongdao Dong Autonomous County, Hunan Province, recently announced the first instance criminal judgment of the case, which found that the above-mentioned coffee contained the chemical drug ingredient "sildenafil" prohibited by the state from being added to food. Yang Mouqian was convicted of selling toxic and harmful food and sentenced to six months in prison with a one-year probation.

According to the court's investigation, starting from 2024, the defendant Yang Mouqian sold sexual health products through the WeChat platform. Subsequently, she learned about a product called "Natural Herbal Coffee" from her WeChat friend, which claimed to have the effect of enhancing sexual functions. On December 7, 2024 and May 15, 2025, Yang Mouqian purchased 20 boxes of coffee involved in the case (each box containing 22 packs) from the above-mentioned WeChat friends twice at a price of 1450 yuan per 10 boxes, and paid a total of 2900 yuan for the goods.

After investigation, it was found that the coffee involved did not obtain a qualified certificate. Yang Mouqian sold products to the outside world at prices ranging from 200 yuan to 500 yuan per box or 20 yuan to 50 yuan per pack, without fulfilling her obligation to inspect product quality through informal channels. During the sale of the implicated coffee, Yang Mouqian also gave away the implicated coffee for free to customers who purchased other sexual health products through promotion. As of July 17, 2025, when Yang Mouqian was seized by the Market Supervision and Administration Bureau of Tongdao County, she had sold 12 boxes of coffee involved in the case, given 6 boxes as gifts to customers through promotion, and 1 box for personal use. 23 packages were seized on site. After verification, the 12 boxes of coffee sold by Yang Mouqian amounted to 3860 yuan.

After the incident, the Market Supervision Administration of Tongdao County sent 4 packets of coffee involved in the case to the Jiangxi Qiushi Judicial Appraisal Center for ingredient identification. After testing, it was found that sildenafil, a chemical drug prohibited by the state from being added to food, was detected.

It was also found that on July 24, 2025, Yang Mouqian voluntarily surrendered to the public security organs, truthfully confessed to her criminal facts, and voluntarily returned some illegal gains.

Witness Mo confirmed that after adding "Xiaoqian" on WeChat, he learned that Xiaoqian was selling "male enhancement coffee" to improve sexual function. On the early morning of May 19, 2025, he spent 20 yuan on WeChat to buy a pack of "male enhancement coffee". After drinking it, he felt hot and mentally excited.

After trial, the court found that the defendant Yang Mouqian violated national food safety management regulations by selling food that she knew contained toxic and harmful non food ingredients, and her behavior constituted the crime of selling toxic and harmful food. According to relevant laws and regulations, the verdict is as follows: the defendant Yang Mouqian is guilty of selling toxic and harmful food and sentenced to six months in prison, suspended for one year, and fined 12000 yuan (the fine has been paid).
