瑞幸咖啡诉泰国“山寨瑞幸”案胜诉Luckin Coffee wins lawsuit against Thailand's "counterfeit Luckin Coffee" case

T之家消息，据瑞幸咖啡官方微博，瑞幸咖啡诉泰国“假瑞幸”商标侵权案胜诉。泰国专门案件上诉法院于 7 月 8 日当庭宣判，全面维持一审原判，认定被告泰国皇家 50R 集团恶意抢注商标和侵权行为成立。

法院判令撤销已注册的瑞幸商标，永久禁止被告在与咖啡业务相关的经营活动中使用“LUCKIN COFFEE”“瑞幸咖啡”及鹿头标识。赔偿方面，被告需支付基础损害赔偿金 1000 万泰铢（现汇率约合 201.4 万元人民币），外加自 2024 年 3 月 4 日起按每日 10 万泰铢（现汇率约合 20138 元人民币）计算的持续性损害赔偿金，总金额逾 9500 万泰铢（IT之家注：现汇率约合 1913.1 万元人民币）。

瑞幸咖啡表示，这是泰国司法史上首例正式承认“商标恶意抢注”概念的代表性判例。案件始于 2022 年初，有网友在泰国发现山寨瑞幸门店，其 LOGO 仅将鹿角翻转方向。瑞幸于 2021 年提起诉讼，经历一审胜诉、二审败诉、被告反诉索赔 100 亿泰铢（现汇率约合 20.14 亿元人民币）的波折后，最终赢得这场历时五年的拉锯战。

The court ruled to revoke the registered Luckin Coffee trademark and permanently prohibit the defendant from using the "LUCKIN COFFEE", "Luckin Coffee", and deer head logo in business activities related to coffee. In terms of compensation, the defendant is required to pay a basic damages compensation of 10 million Thai baht (approximately 2.014 million RMB in current exchange rate), plus ongoing damages calculated at a daily rate of 100000 Thai baht (approximately 20138 RMB in current exchange rate) starting from March 4, 2024, with a total amount exceeding 95 million Thai baht (IT Home Note: The current exchange rate is approximately 19.131 million RMB).

Luckin Coffee stated that this is the first representative precedent in Thai judicial history to officially recognize the concept of "malicious trademark registration". The case began in early 2022 when a netizen discovered a counterfeit Luckin store in Thailand, with its logo only flipping the antlers in the opposite direction. Luckin Coffee filed a lawsuit in 2021 and, after winning the first instance, losing the second instance, and the defendant counterclaiming for 10 billion Thai baht (approximately 2.014 billion yuan in current exchange rate), ultimately won the five-year tug of war.
