「以案释法」非法销售问题咖啡，余江一男子获刑！A man in Yujiang has been sentenced for illegal sale of problematic coffee through case interpretation!

近日，余江区法院依法审结一起销售含有他达拉非成分有毒咖啡的案件，赵某因犯销售有毒有害食品罪，被依法判处刑罚！

案情简介

2022年，赵某在某平台上注册店铺，销售马来西亚咖啡。2023年初，其在明知所售咖啡含有他达拉非成分的情况下，仍继续通过网店对外销售。此后，于某从赵某处购买该咖啡，饮用后出现身体不适。经检测，于某购买的咖啡中含有国家禁止添加的他达拉非成分。2024年11月，赵某被抓获。

法院判决

法院经审理认为，被告人赵某销售明知掺有有毒、有害的非食品原料的食品，已构成销售有毒、有害食品罪，鉴于赵某具有坦白、退赃、认罪认罚、预缴罚金等情节，且未造成严重后果，对被告人赵某判处有期徒刑一年二个月，适用缓刑，并处罚金人民币四万元。

法官说法

销售有毒有害食品，既严重扰乱国家食品安全监管秩序，又直接危及消费者的生命健康权。食品安全关乎民生根本，法治乃是坚实屏障。任何漠视群众健康、逾越食品安全红线的违法犯罪行为，终将受到法律的严厉制裁。

《中华人民共和国刑法》第一百四十四条规定，在生产、销售的食品中掺入有毒、有害的非食品原料的，或者销售明知掺有有毒、有害的非食品原料的食品的，处五年以下有期徒刑，并处罚金。

Recently, the Yujiang District Court concluded a case involving the sale of toxic coffee containing Tadalafil in accordance with the law. Zhao was sentenced to death for the crime of selling toxic and harmful food!

Case Brief

In 2022, Zhao registered a store on a certain platform to sell Malaysian coffee. At the beginning of 2023, despite knowing that the coffee sold contained Tadalafil, it continued to sell through online stores. Afterwards, Yu purchased the coffee from Zhao and experienced physical discomfort after drinking it. After testing, it was found that the coffee purchased by Yu contained Tadalafil, which is prohibited by the country from being added. In November 2024, Zhao was arrested.

Court verdict

After trial, the court found that the defendant Zhao knowingly sold food containing toxic and harmful non food ingredients, which constituted the crime of selling toxic and harmful food. Considering that Zhao confessed, returned the stolen goods, pleaded guilty, and prepaid the fine, and did not cause serious consequences, the defendant Zhao was sentenced to one year and two months in prison, with probation and a fine of RMB 40000.

Judge's Interpretation

Selling toxic and harmful food not only seriously disrupts the national food safety regulatory order, but also directly endangers consumers' right to life and health. Food safety is fundamental to people's livelihoods, and the rule of law is a solid barrier. Any illegal and criminal behavior that ignores public health and crosses the red line of food safety will eventually be severely punished by the law.

Article 144 of the Criminal Law of the People's Republic of China stipulates that anyone who mixes toxic or harmful non food raw materials into food produced or sold, or knowingly sells food containing toxic or harmful non food raw materials, shall be sentenced to fixed-term imprisonment of not more than five years and fined.
